After the accident, police said an officer smelled alcohol on Barry's breath and he was given a field sobriety test, which he failed. Barry was then detained and taken to the First District Police Station where he was given a blood alcohol test, which showed he was not legally intoxicated. Sources told News4 that Barry's blood-alcohol content was far below the legal limit of .08.Barry was issued a $50 ticket for failure to yield the right of way, taken back to his car and allowed to drive home. He told News4 that he had been in the area visiting a friend from out of town, but declined to comment further.Authorities said the incident does not violate the conditions of his plea agreement reached last year to settle an income tax case. As part of the agreement, Barry agreed to undergo periodic drug testing.
