Barry Faces Sentencing On Wednesday

WASHINGTON -- D.C. City Councilman Marion Barry faces sentencing in federal court Wednesday on misdemeanor tax charges.He pleaded guilty last October to failing to file tax returns for six years.Barry reportedly struck a plea agreement with federal prosecutors as part of that deal. Prosecutors agreed not to take a stand on Barry's request for probation instead of jail time, but according to The Washington Post, prosecutors are insisting upon some conditions, namely that Barry will undergo regular drug testing and remain drug-free.
According to court papers filed Monday, Barry tested positive for cocaine and marijuana in a court-ordered test taken in November.Barry could receive as much as 18 months in jail and a $100,000 fine.Another wrinkle in the plea deal are those tax returns and whether or not they have been filed.According to the Post prosecutors said to their knowledge they had not seen those tax returns and they did not have any information indicating that they had been filed.Barry's attorney is not commenting.
