Malvo's Lawyers Upset Over Denied Request

FAIRFAX, Va. -- Defense attorneys for 17-year-old John Lee Malvo were in a Fairfax County juvenile court Tuesday to request three motions in the case.
Malvo's lawyers lost a bid to have the county pay for and provide ballistics and psychiatric experts at this stage of the proceedings. The judge called it premature.
Malvo's lawyer, Michael Arif, said that while he respects the judge's decision, he disagreed with prosecutors' arguments that the tests would be too expensive.
However two other motions were granted. The prosecution team agreed to turn over copies of its evidence by Dec. 20. Defense lawyers had requested more information about the police case against Malvo.
Also Tuesday, both sides agreed that a probable cause hearing scheduled for next month will be delayed until Jan. 14.
The young sniper suspect faces a capital murder charge in the Oct. 14, shooting of Linda Franklin. She was an analyst for the FBI who was killed in the parking lot of the Home Depot store in Falls Church, Va.
Malvo's defense struck out on Friday. In three separate hearings they failed to get him out of the adult jail, to get a gag order in the case, and to end what they claim is inhumane treatment.
Fellow sniper suspect John Allen Muhammad remains locked up in Prince William County, where he'll face a capital murder charge in the shooting death of Dean Harold Meyers, of Gaithersburg, Md., at a gas station in Manassas, Va., on Oct. 9.
